The Kerala High Court has decided not to reinstate Kerala University Registrar KS Anil Kumar following his suspension for canceling a seminar featuring Governor Rajendra V. Arlekar due to a Bharat Mata portrait display with a saffron flag. The court made this ruling during a hearing on Kumar’s appeal against his suspension, with Justice TR Ravi presiding. The court upheld the suspension and directed the University’s Vice-Chancellor to convene a Syndicate meeting to determine the suspension’s continuation.
The controversy began on July 2 when Kumar issued a notice canceling an event at the University Senate Hall after the Bharat Mata portrait with a saffron flag was exhibited on stage. The event was graced by Kerala Governor Arlekar, who serves as the University Chancellor. The cancellation notice, issued while the Governor was present on stage, was viewed as disrespectful, leading to Kumar’s suspension.
Although the University Syndicate initially moved to lift the suspension on July 6, the Vice-Chancellor declined to endorse the decision and issued subsequent directives upholding Kumar’s suspension. The Vice-Chancellor further prohibited Kumar from campus entry and official file handling, prompting Kumar to challenge these actions, alleging abuse of authority and overstepping by the Vice-Chancellor.
During previous hearings, Justice Ravi likened the Registrar-VC conflict to a “cat and mouse game.” While the Court refrained from direct intervention, it stressed the importance of a clear Syndicate decision on the suspension’s status. The larger context of this case reveals a broader power struggle between the State government and the Governor over the usage of the Bharat Mata portrait with a saffron flag at official functions, a practice opposed by ministers citing its religious connotations.
Following the Court’s decision, the Left majority Syndicate expressed intent to seek a Syndicate meeting with the Vice-Chancellor to address the suspension issue. The legal battle underscores the complexities of administrative authority and the delicate balance between institutional autonomy and political influence within academic settings.
As the case unfolds, it sheds light on the intricate dynamics between university officials, highlighting the challenges of maintaining institutional integrity amidst differing ideological stances.
